Amendments
A suite of planning scheme amendments have been prepared
to further the implementation of the objectives of the Doncaster
Hill Strategy.
They are:
AMENDMENT VC59 - Activity Centre Zone (ACZ1)
In September 2009, the Minister for Planning announced the
introduction of a new Activity Centre Zone (ACZ1) for Doncaster
Hill, as part of Amendment VC59. ACZ1 guides the use and development
of land within Doncaster Hill and encourages a mix of uses
to facilitate business, shopping, employment, housing, leisure
and community facilities. The zone covers the whole of Doncaster
Hill with the exception of Doncaster Primary School, which
remains in a Public Use Zone.
Doncaster Hill was the first of five 'market ready' Activity
Centres in Victoria to have the zone applied.
Whilst the Amendment introduced by the Minister was generally
a direct translation of the previous controls, ACZ1 better
reflects Council's vision for Doncaster Hill's seven precincts
and has significantly reduced the number of planning controls
relating to Doncaster Hill.
The amendment was introduced on 17 September 2009.
AMENDMENT C81
The amendment makes a minor amendment to Schedule 1 to the
Comprehensive Development Zone (CDZ1) to change the amount
of retail floor space permitted for a shop in the CDZ1. In
particular, it changes the condition in the Section 2 Table
of Uses in order that a shop could be located at the entire
ground level, or 15 per cent of the total lot area, whichever
is the greater.
This change was sought in response to a concern being raised
by an owner of a prominent site on Doncaster Hill and in light
of Council’s process to pursue a permanent zone solution
to replace the CDZ1 interim controls in place till 31 December
2009.
AMENDMENT C76
This amendment rezones Council owned land (600A Doncaster
Road, 2 Elgar Court, 101 Tram Road) and privately owned land
(3 Elgar Court and part of Elgar Court - road, Doncaster)
to a Comprehensive Development Zone (CDZ1). This Zone encourages
a mix of uses including high density residential development
and a variety of retail, commercial, social, community and
entertainment uses.
The amendment implements one of the recommendations made
in the report from the Priority Development Panel (December
2007). The Panel reviewed the extent of the Comprehensive
Development Zone (CDZ1) within the Activity Centre and recommended
that it be extended to include the subject land (as well as
other locations).
The amendment was approved by the Minister for Planning on
23 October 2008.

AMENDMENT C72
This amendment removes the restrictive covenant from each
of the following properties:
- 16 Hepburn Road, Doncaster
- 18 Hepburn Road, Doncaster
- 20 Hepburn Road, Doncaster
- 22 Hepburn Road, Doncaster
- 24 Hepburn Road, Doncaster
- 1 Short Street, Doncaster
All of these properties are located within the Doncaster
Hill Activity Centre.
Amendment C72 is a result of a recommendation of the Priority
Development Panel Report (December 2007) to prepare and exhibit
a planning scheme amendment to remove the restrictive covenants
from the relevant properties to ensure that all land in the
Doncaster Hill Activity Centre is development ready. This
will then enable the subject properties to be developed in
accordance with the objectives of the Doncaster Hill Strategy
(October 2002 and revised October 2004) and the provisions
of the Manningham Planning Scheme.
Amendment C72 was approved by the Minister for Planning on
18 December 2008.

AMENDMENT C73
The Minister for Planning, The Honourable Justin Madden,
has approved Amendment C73 to the Manningham Planning Scheme,
which will assist Manningham Council to attract more investment
to Doncaster Hill.
The amendment came into operation on 20 December 2007.
The Amendment modifies the existing Schedule
1 to the Comprehensive Development Zone which applies
to part of the Doncaster Hill Activity Centre, by inserting
a new expiry date of 31 December 2009 (refer to Amendment
C45, which introduced the Comprehensive Development Zone and
Schedule 1).
Amendment C73 also makes one minor change to the zone provisions
by allowing for a mix of two rather than three uses on a site,
with ‘residential’ still being required as the
predominate use. The new interim controls will expire on 31
December 2009.
The Minister commended Council for its excellent work in
preparing and implementing the Doncaster Hill Strategy.
“This minor change to the zone provisions is a small,
yet significant step in fine-tuning the existing planning
scheme controls to attract more investment to Doncaster Hill”,
said Minister Madden.

AMENDMENT C35
This amendment incorporates the Doncaster Hill Parking Precinct
Plan, April 2004, into the Manningham Planning Scheme. The
Plan, developed by GTA Consultants for Council, sets out the
parking provisions for the Doncaster Hill Activity Centre.
This Amendment has been forwarded to the Minister for Planning
for approval into the Manningham Planning Scheme.

AMENDMENT C37
Amendment C37 is the corrective amendment to Amendment C30.
It identifies properties to be covered by the Public Acquisition
Overlay to enable the delivery of appropriate open space for
the Doncaster Hill Activity Centre.
The Independent Panel heard the submissions to Amendments
C30 and C37 in August 2004 and a Panel Report was delivered
in December 2004.The Report recommended that Council adopt
C30 and C37 with some changes. Council supported the Panel's
recommendations, with the respective changes made to the Amendments
and forwarded to the Minister for Planning in June 2005.
Amendments C30 and C37 were lodged for Ministerial approval
in June 2005. Amendment C37 was approved by the Minister for
Planning and incorporated into the Manningham Planning Scheme
on 18 August 2005.
AMENDMENT C30
Amendment C30 combines three separate, but related items,
by introducing a Development Contributions Plan (DCP) within
the Doncaster Hill Activity Centre; introducing a Public Acquisition
Overlay over a number of properties within and surrounding
the Doncaster Hill Activity Centre and specifies a mandatory
public open space contribution rate of five per cent for all
subdivision applications within Doncaster Hill.
The Independent Panel heard the submissions to Amendment
C30 and the related Amendment C37 in August 2004 and a Panel
Report was delivered in December 2004. The Report recommended
that Council adopt C30 and C37 with some changes. Council
supported the Panel's recommendations, with changes being
made to the Amendments in accordance with the Panel Report
and the Amendments were forwarded to the Minister for Planning
in June 2005.
Amendment C30 and C37 was lodged for Ministerial approval
in June 2005. Amendment C30 was approved by the Minister for
Planning and incorporated into the Manningham Planning Scheme
on 8 September 2005.

AMENDMENT C45
On 24 March 2005 Ministerial Amendment C45 was introduced
into the Manningham Planning Scheme. The amendment rezones
approximately 8.2 hectares of land from a Business 2 Zone
to a Comprehensive Development Zone and introduces Schedule
1 to the Comprehensive Development Zone. The Schedule
refers to the ‘Doncaster Hill Comprehensive Development
Plan’ (September 2004), which is an incorporated document
in the Scheme.
This Plan outlines the vision for the Doncaster Hill Activity
Centre and complements the other provisions in the Manningham
Planning Scheme which relate to the Doncaster Hill Activity
Centre.
The Comprehensive Development Zone and Schedule 1 expire
after 31 December 2007.

AMENDMENT C33
Amendment C33 references the Doncaster Hill Strategy (October
2002) within the Manningham Planning Scheme. It includes a
variety of planning tools to ensure that the environmental,
social, economic, cultural, landscape and visual attributes
of the Doncaster Hill Activity Centre are protected and enhanced.
Amendment C33 was approved by the Minister for Planning
and was incorporated into the Manningham Planning Scheme on
February 26, 2004.
